These Terms govern your use of Railcade, a game provided by Daygull Studios LLC. By using the game, you agree to these Terms. If you do not agree, do not use the service.

Eligibility

You must be legally able to agree to these Terms. If you are under the age of majority where you live, a parent or guardian must authorize your use. Railcade is not directed to children under 13.

Your license

We grant you a personal, limited, revocable, nonexclusive, nontransferable license to use Railcade for lawful entertainment. Daygull Studios and its licensors retain all rights in the game, branding, software, art, audio, and service.

Accounts and progress

You may play locally. Optional account protection can link a supported sign-in provider to cloud progress. You are responsible for your provider account and device security. Scores, achievements, unlocks, and remote content are service features, not property or currency, and may be corrected when affected by bugs, abuse, or invalid data.

Acceptable use

Do not cheat, automate play, exploit bugs, interfere with the service, access another person’s data, reverse engineer except where law expressly permits it, bypass security, or use Railcade unlawfully. We may limit or terminate access reasonably needed to protect players, the service, or legal rights.

Updates and availability

We may update gameplay, balance, themes, achievements, remote content, and technical requirements. The service may be interrupted or discontinued. We do not promise that every feature, score, or item will remain available forever.

Purchases and advertising

The current private playtest does not offer paid items or request production third-party ads. Future store purchases, subscriptions, or advertising will be disclosed before use and may be governed by additional store or product terms.

Disclaimers

To the fullest extent permitted by law, Railcade is provided “as is” and “as available” without warranties of uninterrupted operation, error-free play, fitness for a particular purpose, or preservation of every score or item.

Limitation of liability

To the fullest extent permitted by law, Daygull Studios and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, lost profits, or loss of goodwill arising from Railcade. Where liability cannot be excluded, total liability will not exceed the greater of the amount you paid for Railcade during the prior twelve months or US $25.
